Conviction under section 462-L Fine Rs.5000 by trial court.
Question on 2025-11-26 (Area of Law Arbitration)

Can I submit an appeal against the conviction in High Court and in how many days after the first trial court order.

Answer(1)

Answer 1

An appeal against the conviction by a Magistrate or lower court is filed in the Court of Sessions. If the conviction is by a Sessions Court, the appeal lies with the High Court. Along with the appeal, a petition for the suspension of the sentence (bail pending appeal) can be filed, especially if the sentence is not severe or the conviction is based on weak evidence. Limitation to file appeal are 30 days for magistrate-to-sessions appeals, and 60 days for sessions-to-high court appeals.
